Welcome to Above the Worry Line (“Company,” “we,” “us,” or “our”). This Terms of Use Agreement (“Agreement”) governs your access to and use of our cabin property located in Gatlinburg, Tennessee, including any related website, booking platform, or services (collectively, the “Property”).

By booking, accessing, or staying at the Property, you agree to be bound by this Agreement. If you do not agree, you may not use the Property.

1. ELIGIBILITY & AGE REQUIREMENT

You must be at least eighteen (18) years of age to book, rent, or occupy the Property. By booking the Property, you represent and warrant that you meet this requirement and have the legal capacity to enter into this Agreement.

2. BOOKING & OCCUPANCY

  • Only the individuals listed in the reservation may occupy the Property.

  • No subleasing, assigning, or transferring of the booking is permitted.

  • Maximum occupancy limits must be strictly followed as outlined in your booking confirmation.

3. USE OF PROPERTY

You agree to:

  • Use the Property for lawful, residential, short-term lodging purposes only

  • Comply with all local, state, and federal laws, including Gatlinburg and Sevier County regulations

  • Maintain the Property in good condition and report any damage promptly

You agree not to:

  • Engage in illegal activity

  • Host parties or events unless expressly authorized in writing

  • Disturb neighbors through excessive noise or disorderly conduct

  • Smoke or use illegal substances on the Property (unless explicitly permitted)

4. HOUSE RULES

Guests must comply with all house rules provided at the Property or through the booking platform. Failure to follow house rules may result in immediate termination of your stay without refund.

5. DAMAGE, LOSS & FEES

You are responsible for:

  • Any damage to the Property, furnishings, or amenities caused by you or your guests

  • Excessive cleaning required beyond normal use

  • Missing or stolen items

We reserve the right to charge the payment method on file or submit a claim through the booking platform for damages or losses.

6. ASSUMPTION OF RISK

The Property is located in a mountainous area. By staying at the Property, you acknowledge and assume all risks associated with:

  • Stairs, decks, hot tubs, fireplaces, grills, wildlife, weather conditions, and terrain

  • Slips, falls, or injuries occurring on or around the Property

You agree that Above the Worry Line is not responsible for injuries, accidents, or illness occurring during your stay, except where required by Tennessee law.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by Tennessee law, Above the Worry Line shall not be liable for:

  • Personal injury, death, or property damage

  • Loss or theft of personal belongings

  • Service interruptions, utilities outages, or internet failures

Our total liability shall not exceed the amount paid for your stay.

8. INDEMNIFICATION

You agree to indemnify and hold harmless Above the Worry Line, its owners, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Property

  • Violation of this Agreement

  • Acts or omissions of you or your guests

9. TERMINATION

We reserve the right to terminate your stay immediately, without refund, for:

  • Violation of this Agreement or house rules

  • Illegal or unsafe conduct

  • Misrepresentation of booking details

10. GOVERNING LAW & VENUE

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee. Any disputes shall be resolved exclusively in the state or federal courts located in Tennessee.

11. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

12. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and Above the Worry Line regarding use of the Property and supersedes any prior agreements or understandings.
